What ideas are important for alimony or spousal support in North Carolina? That's a great question. We want to look at the incomes of the parties, particularly at the data separation. We look at historical income and earning capacities for the parties. We look at their future earning capacities as well.
If we look at what are the needs of the dependent spouse, and what's the ability of the supporting spouse to pay that? In North Carolina, the dependent spouse is a spouse that makes less money than the other spouse. The supporting spouse obviously is the spouse that makes more money. That's determined as of the date of separation.
Once we know that, we look at what are the expenses of the household when the parties separated, that is your lifestyle to which you became accustomed during the marriage. The test for alimony in North Carolina is support paid from the supporting spouse, the dependent spouse, to the extent to which he or she needs it, to maintain the lifestyle which he or she became accustomed during the marriage.
