Cyber spying is a topic that comes up a lot in family law. Frequently we get asked, can I look at my spouse's laptop or computer or an app that's on one of those devices and each situation? It's very specific to what it is that you are trying to access the device in both the app. By way of example, a lot of times we'll ask, do you have the password to the particular app?
Do you have the password to the laptop? What type of use is typical on that laptop or iPad or cell phone? Is it common for you to access it? In other words? All these things go to an expectation of privacy. Each situation is highly specific to what it is that you're obtaining and how you're obtaining it. It's always good to talk to an attorney about what it is that you're hoping to get from the device before you do it, because there are significant consequences if you do something that you should not.
