Cyber spying is a topic that comes up a lot in family law. Frequently we get asked, can I look at my spouse's laptop or computer or an app that's on one of those devices and each situation? It's very specific to what it is that you are trying to access the device in both the app. By way of example, a lot of times we'll ask, do you have the password to the particular app?

Do you have the password to the laptop? What type of use is typical on that laptop or iPad or cell phone? Is it common for you to access it? In other words? All these things go to an expectation of privacy. Each situation is highly specific to what it is that you're obtaining and how you're obtaining it. It's always good to talk to an attorney about what it is that you're hoping to get from the device before you do it, because there are significant consequences if you do something that you should not.

They're both civil consequences and potentially criminal consequences. Wiretapping is something that we frequently advise our clients about. And before you're looking into someone's laptop or cell phone, talk with an attorney and get specific guidance for your exact situation. If you're looking for more information and answer to your questions about wiretapping, please feel free to contact our office by phone.

Look on our website for additional information, or fill out the contact information on our website. And after it's submitted, someone from the office will reach out to you about scheduling an appointment so that we can meet and talk about this important topic.
