If custody issues are not resolved, does that make a divorce contested when speaking about the divorce action? I tend to be very precise in telling clients that the divorce is treated as a separate case from the other portions of your case. The divorce addresses your marital status. Custody involves your child or children.
The divorce can go through making you a single person, and there will be issues about custody that are unresolved. When I talk about an uncontested divorce, it means that the parties are in agreement that they've been separated for a year and a day. If there's a contested custody case, we try to address that with a very specific phrase of saying a contested custody case so that we're clear to distinguish for you, the client, the difference between each of the claims you may have.
