How can I prove if my spouse has had an affair in North Carolina? The test for proving an affair is opportunity and inclination. What you need to show the court is the person had the opportunity to do so, and had the inclination to do so. Proof does not mean you have to have a video. It doesn't mean that you have to have pictures or some type of written confession.
Proof of an affair is determined by the totality of the circumstances, meaning you have to prove opportunity and inclination. If we can prove that the supporting spouse committed adultery prior to separating, that can be used to help support your alimony claim.
