My name is Charles Allman, and a question that I get asked frequently is, what can I do if my spouse is hiding assets? When a spouse is hiding assets, it's very important to do discovery. That means requesting a full and fair disclosure of all financial dealings. What else can I do if I'm afraid that my spouse is hiding assets?
A lot of times we will hire a forensic accountant to help us review the financial documents presented and determine if there's reason to believe that assets have been hidden by moving somewhere else here that have not been accounted for going into the marital accounts, how would I know if my spouse is hiding assets?
What are the signs? One would be establishing multiple financial accounts. Second, we look for a lot of transactions occurring between the marital accounts. Frequently when someone is hiding assets, there will be a shuffling of assets back and forth between accounts to make it harder to follow the financial trail.
Another sign of hiding assets would be fake deaths. These are deaths that look as though they're paying either vendors or third parties, but in fact are being put into an account that the spouse is unaware of. The other side of hidden assets would be sudden spending changes. Are there atypical cash withdrawals during the marriage?
It's important to notify us as your attorneys early on if you believe that they're hidden assets, so that we can begin the process of outlining what to ask for and who we may need to have, help us review the financial records.
