What is a parenting plan? A parenting plan can be a contract, but it also can be a court order. Frequently, clients will ask, can we make it a court order that is enforceable by the powers of contempt of the court? So you would take the parenting agreement and turn it into a court order by petitioning the court to make it a court order?
The question I get asked is, do I have to make it a court order to make it enforceable? The answer is no. The agreement, if written and signed by both parties before a notary, will be enforceable as a contract. You could also make it enforceable by a court order and enforceable by contempt of court, which is what a lot of our clients prefer to do.
